Public Charge has historically been applied in only very narrow circumstances. The newly issued public charge rule taking effect today, strips away long-established safeguards and instead institutes overbroad government discretion and few meaningful guidelines for how individual cases should be evaluated. That lack of structure gives immigration authorities significantly greater latitude to apply their own judgment—creating greater opportunity for personal bias, inconsistent decision-making, and discrimination to influence who is deemed a public charge. In response, Western Center developed this position statement to make clear that this approach is not only inherently discriminatory, but also undermines fairness, family stability, economic integration, and the ability of immigrants to build secure and self-sufficient lives in the United States.
